Financial planning for NRIs investing in India: accounts, rules and taxation
NRE or NRO, what is repatriable, how TDS works on redemption, and where DTAA relief actually applies.
NRIs can invest in Indian mutual funds under FEMA on a full repatriation or non-repatriation basis. The mechanics are straightforward once the account structure is right; the friction usually comes from KYC, tax deducted at source and jurisdiction restrictions.
NRE vs NRO: pick before you invest
| NRE account | NRO account | |
|---|---|---|
| Source of funds | Foreign earnings remitted to India | Income earned in India — rent, dividends, pension |
| Repatriation | Freely repatriable, principal and interest | Up to USD 1 million per financial year, with CA certification |
| Interest taxation in India | Exempt | Taxable |
| Investment basis | Repatriable | Non-repatriable (or within the annual limit) |
Investments made from an NRE account can be repatriated on redemption. Investments made from an NRO account are treated as non-repatriable, so choose the debit account according to whether you want the money to leave India later.
KYC and compliance
- NRI KYC requires passport, visa or residence permit, overseas address proof and PAN, usually attested by the Indian embassy, a notary or an authorised bank official.
- FATCA and CRS declarations are mandatory, including your tax identification number in the country of residence.
- Most AMCs restrict or decline investments from US and Canada-based investors due to FATCA reporting obligations; a limited set of AMCs accept them, often with offline paperwork only.
- Update your residential status with your bank, AMCs and depository when you become an NRI — resident folios cannot simply continue unchanged.
Taxation and TDS
The capital gains tax rates are the same as for resident investors, but NRIs face TDS at source on redemption rather than paying at the time of filing. For equity-oriented funds this is generally 20% on short-term gains and 12.5% on long-term gains above the annual exemption; other funds are deducted at applicable rates. Excess deduction is recovered by filing an Indian income tax return.
India has Double Taxation Avoidance Agreements with most major countries. Depending on the treaty, tax paid in India may be credited against your liability abroad, or a lower withholding rate may apply. A Tax Residency Certificate from your country of residence is normally required to claim treaty benefits.
Insurance for NRIs
NRIs can buy term insurance from Indian insurers, often at Indian premium rates that are materially lower than in many Gulf and Western markets. Underwriting may require a medical examination in India or an accepted overseas equivalent, and the payout is made in India to the nominee. Disclose your country of residence, travel pattern and occupation accurately — this affects both acceptance and pricing.
Practical planning checklist
- 1Convert resident savings accounts to NRO and open an NRE account for fresh remittances.
- 2Re-do KYC with NRI status and update FATCA and CRS declarations.
- 3Decide repatriable versus non-repatriable for each goal before investing.
- 4Keep a mandate holder or power of attorney in India for operational continuity.
- 5Maintain nomination on every folio, bank account and insurance policy.
- 6File an Indian return where TDS exceeds actual liability, and claim DTAA relief with a Tax Residency Certificate.
